Compliance agreement
This notice is published by the Commissioner of Canada Elections, pursuant to section 521 of the Canada Elections Act, S.C. 2000, c. 9, as amended.
On April 12, 2005, the Commissioner of Canada Elections, pursuant to section 517 of the Canada Elections Act, entered into a compliance agreement with the contracting party, of the city of Montréal, Québec, Canada.
In this agreement, the contracting party admits having contravened paragraph 164(2)(b) of the Canada Elections Act by showing his ballot, after it had been marked, to the television cameras and individuals present at the polling station in Outremont, Quebec, so as to reveal the name of the candidate he voted for.
Prior to the conclusion of the agreement, the Commissioner of Canada Elections took into account that the contracting party published the highlights of the compliance agreement in the newspaper Le Point, of Outremont, Quebec, that he acknowledged the importance of maintaining the secrecy of the vote and that he undertook to respect the secrecy of the vote in the future.
In summary, the agreement required the contracting party to
- admit to the truthfulness of the facts and admit responsibility
for the facts that constitute the offence;
- acknowledge the importance of maintaining the secrecy of the
vote; and
- undertake to henceforth observe the provisions of the Canada Elections Act relating to the secrecy of the vote.
