Compliance agreement

This notice is published by the Commissioner of Canada Elections, pursuant to section 521 of the Canada Elections Act, S.C. 2000, c. 9.

On April 25, 2007, the Commissioner of Canada Elections entered into a compliance agreement with the Contracting Party, of the City of Thunder Bay, Province of Ontario, pursuant to section 517 of the Canada Elections Act.

The Contracting Party has acknowledged acts that constitute an offence under section 405.21 of the Canada Elections Act, that she solicited contributions on behalf of the Thunder Bay–Rainy River Conservative Association, making a representation to potential contributors that part of their contributions would be transferred to a person or entity other than the electoral district association, an act that is prohibited by section 405.21 of the Act. In particular, the solicitation through a newspaper advertisement, offered contributors a tax receipt to allow their donation to earn them a tax credit for donations that would be forwarded to a family for its medical fundraising initiative.

The Contracting Party has also acknowledged that a clarification notice and second advertisement were placed by the Association stating that money received by the Association would be used to develop health care policies, with which the family had agreed to assist. The clarification distinguished this from direct donations to the family.
