Compliance agreement under section 517 of the Canada Elections Act
This notice is published by the Commissioner of Canada Elections, pursuant to section 521 of the Canada Elections Act, S.C. 2000, c. 9.
On January 15, 2007, the Commissioner of Canada Elections entered into a compliance agreement with the contracting party pursuant to section 517 of the Canada Elections Act, by its authorized signatory Marc Emery of the city of Vancouver, in the province of British Columbia, Canada.
In this agreement, the contracting party admits to acts that constituted offences under paragraphs 496(1)(c) and 496(1)(f) of the Act, as it failed to register as a "third party" during the election period of the 38th federal general election and failed to file an election advertising report, after having incurred $500 in election advertising expenses. The contracting party also undertakes that should it become a third party subject to registration in any subsequent federal election it will register and file an election advertising report.
Prior to the conclusion of the agreement, the Commissioner of Canada Elections took into account that
- the financial information required to be filed has been provided
- the group eNDProhibition has registered as a "third party" in the general election held on January 23, 2006
- the contracting party donated to a non-partisan charitable organization of its choice
