Compliance agreement
This notice is published by the Commissioner of Canada Elections, pursuant to section 521 of the Canada Elections Act, S.C. 2000, c. 9.
On July 30, 2004, the Commissioner of Canada Elections entered into a compliance agreement with the contracting party in the city of Saint-Jérôme, Quebec, Canada, pursuant to section 517 of the Canada Elections Act.
In this agreement, the contracting party, communications manager for the campaign of the candidate Lorraine Auclair in the electoral district of Rivière-du-Nord, recognizes having breached paragraph 495(1)(a) of the Canada Elections Act by publishing and distributing pamphlets without mention of the authorization of the official agent, contrary to section 320 of the Act. Pamphlets were published and distributed to all addresses in the electoral district of Rivière-du-Nord.
Prior to the conclusion of the agreement, the Commissioner of Canada Elections took into account that the contracting party published corrections in the following local newspapers: Le Mirabel and L'Écho du Nord.
In summary, the agreement required the contracting party to
- acknowledge the requirement to indicate in all election advertising the official agent's authorization;
- admit to the truthfulness of the facts and admit responsibility for the acts that constitute the offence; and
- undertake to observe the requirements of the Act and to henceforth respect them.
