Compliance Agreement
This notice is published by the Commissioner of Canada Elections, pursuant to section 521 of the Canada Elections Act, S.C. 2000, c.9.
On May 2, 2002, the Commissioner of Canada Elections, pursuant to section 517 of the Canada Elections Act, entered into a compliance agreement with the contracting party, in the city of Toronto, Ontario, Canada.
In this agreement, the contracting party acknowledges having breached section 7 of the Canada Elections Act, by requesting two ballots at the general election held on November 27, 2000, after registering on polling day in the electoral districts of Simcoe–Grey and of Trinity–Spadina.
Prior to the conclusion of the agreement, the Commissioner of Canada Elections has taken into account that the contracting party contributed to the works of a registered non-partisan charitable organization, the Actor's Fund of Canada, located in Toronto, in the province of Ontario, as a recognition of the seriousness of the offence.
In summary, the agreement required the contracting party to:
- admit to the truthfulness of the facts and admitresponsibility for
the acts that constitute the offence;
- recognize that requesting a second ballot at the same federal election is
prohibited by the Act;
- appreciate the gravity of his actions in the electoral process;
- undertake to comply with the provisions of the Canada Elections Act and to cast a vote only once and in accordance with the provisions of the Act where hedecides to exercise his right to vote at a future election.
