Compliance Agreement
This notice is published by the Commissioner of Canada Elections, pursuant to section 521 of the Canada Elections Act, S.C. 2000, c. 9.
On May 16, 2002, the Commissioner of Canada Elections, pursuant to section 517 of the Canada Elections Act, entered into a compliance agreement with the contracting party, of Port Moody, British Columbia, Canada.
In this agreement, the contracting party acknowledges having breached section 7 of the Canada Elections Act, by requesting a second ballot at an advance poll on November 18, 2000, during the 2000 general election in the electoral district of Vancouver East. The contracting party had already voted at that election on November 18, 2000 at an advance poll in the electoral district of Port Moody–Coquitlam–Port Coquitlam with the mistaken belief that an elector who was registered to vote in two electoral districts could vote twice.
Prior to the conclusion of the agreement, the Commissioner of Canada Elections has taken into account that the contracting party has contributed to the works of a registered non-partisan charitable organization, Oxfam Canada, located in the city of Ottawa, in the province of Ontario, as a recognition of the seriousness of the offence.
In summary, the agreement required the contracting party to:
- admit to the truthfulness of the facts and admitresponsibility for
the acts that constitute the offence;
- recognize that requesting a second ballot at the same federal election is
prohibited by the Act regardless of whether one is registered to vote more
than once in one or more electoral districts;
- appreciate the gravity of his actions in the electoral process;
- undertake to comply with the provisions of the Canada Elections Act and to cast a vote only once and in accordance with the provisions of the Act where he decides to exercise his right to vote at a future election.
