Compliance agreement
This notice is published by the Commissioner of Canada Elections, pursuant to section 521 of the Canada Elections Act, S.C. 2000, c. 9.
On May 31, 2006, the Commissioner of Canada Elections entered into a compliance agreement with the contracting party, of the City of Toronto, Province of Ontario, pursuant to section 517 of the Canada Elections Act.
The contracting party has acknowledged acts that constitute an offence under section 405.21 of the Canada Elections Act, that he, as official agent for a candidate in the general election of 2006, solicited contributions on behalf of a candidate, making a representation to potential contributors that part of their contributions would be transferred to a person or entity other than the candidate, an act that is prohibited by section 405.21 of the Act. In particular, the solicitation offered contributors one or more gift certificates from specified retailers, to be acquired and provided to the contributor in return for and according to the amount of the contribution, after a contribution had been made.
Prior to the conclusion of the agreement, the Commissioner of Canada Elections took into account that:
- the contracting party acknowledged responsibility for having solicited contributions on behalf of a candidate at the 2006 general election and representing to potential contributors that part of their contributions would be transferred to a person or entity other than the candidate; and
- the contracting party had sent a letter to all persons who responded to the solicitation to advise them that the offer described therein of a gift certificate in return for each contribution received could not be made, to confirm the amount that the contributor wished to contribute and to indicate that a tax receipt would only be issued for the amount of the monetary contribution.
