COMMISSIONER OF CANADA ELECTIONS
CANADA ELECTIONS ACT
This notice is published by the Commissioner of Canada Elections, pursuant to section 521 of the Canada Elections Act, S.C. 2000, c. 9.
On January 27, 2012, the Commissioner of Canada Elections entered into a compliance agreement with Ms. Ana-Marija Petrunic (hereinafter referred to as the Contracting Party) of the city of Calgary, province of Alberta, pursuant to section 517 of the Canada Elections Act.
The Contracting Party, who was the official agent for Josipa Petrunic, the Liberal Party of Canada candidate in the electoral district of Calgary East during the 2011 federal general election, has acknowledged acts that contravene section 320 and constitute an offence under paragraph 495(1)(a) of the Canada Elections Act.. The Contracting Party acknowledges publishing and distributing, during the 2011 election period, in Calgary East, election advertising that failed to mention the authorization of the official agent, contrary to section 320. The advertisements in question appeared on the campaign website, billboards, postcards, and in some local newsletters.
Prior to the conclusion of the agreement, the Commissioner of Canada Elections took into account that the Contracting Party published a correction notice in the Calgary Sun on January 25, 2012. In summary, the compliance agreement required the Contracting Party to:
- acknowledge the requirement to mention the official agent's authorization in or on all election advertising of the candidate;
- admit to the truthfulness of the facts and admit responsibility for the acts that constituted the offence; and
- publish a corrective notice in a local newspaper.
