Key facts of violation
As the financial agent for Aladin Legault d’Auteuil, a nomination contestant in the electoral district of Montmagny–L’Islet–Kamouraska–Rivière-du-Loup during the 2019 Liberal Party of Canada nomination contest, Diane Pelletier was required, by virtue of subsection 476.75(1) of the Act, to file the Nomination Contestant’s Campaign Return (Return). The deadline to submit the Return was December 2, 2019.
Elections Canada confirmed that as of January 24, 2022, the Return has still not been submitted to the Chief Electoral Officer.
There are therefore reasonable grounds to believe that Diane Pelletier failed to provide the Return, as required by subsection 476.75(1).
The final AMP amount was set at $300, taking into account one mitigating factor. A mitigating factor (any other aggravating and mitigating circumstances) was applied as the Return was ultimately submitted.
