Key facts of violation

As the financial agent for Gerry Hawes, a Liberal Party of Canada contestant in the electoral district of Simcoe North during the 2019 nomination contest, Robert Kennedy was required, by virtue of subsection 476.75(7) of the Act, to file the Nomination Contestant's Campaign Return (Return), within four months after the selection date. The deadline to submit the Return was November 14, 2019.

Elections Canada has confirmed that the Return was submitted to the Chief Electoral Officer on June 30, 2020, 228 days after the deadline. There are therefore reasonable grounds to believe that Robert Kennedy failed to provide the Return within four months after the selection date, as required by subsection 476.75(7).

The AMP’s baseline amount was reduced based on a mitigating factor, as Robert Kennedy made reasonable efforts to mitigate or reverse the violation’s effects.
