As the New Democratic Party of Canada candidate in the electoral district of Saint Boniface—Saint Vital during the 43rd federal general election held on October 21, 2019, Billie Cross received 16.98% of the votes cast. Subsection 477.1(2) of the Canada Elections Act (the Act) requires that an auditor be appointed without delay, inter alia, when a candidate has received 10% or more of the votes cast in their electoral district. Billie Cross was therefore required to appoint an auditor without delay, but only did so on March 31, 2021, 528 days after polling day.
There are therefore reasonable grounds to believe that Billie Cross contravened subsection 477.1(2).
