Key facts of violation

On January 20, 2020, the official agent for Danny Boudreault, a People’s Party of Canada candidate during the 43rd federal general election held on October 21, 20219, submitted the Candidate's Electoral Campaign Return (Return) via the Political Entities Service Centre portal.

In order for the Return to be considered submitted to the Chief Electoral Officer, the candidate had to activate his account on the portal and provide digital consent by February 21, 2020, which Danny Boudreault did not do. It was not until April 24, 2021 that the official agent was able to submit the Return, after receiving the candidate’s declaration, 428 days after the deadline.

There are therefore reasonable grounds to believe that Danny Boudreault failed to send to his official agent, within four months of polling day, a declaration that the Return is complete and accurate, which is contrary to subsection 477.59(8) of the Canada Elections Act.
