As the candidate for the People’s Party of Canada in the electoral district of Oshawa during the 43rd federal general election, Eric MacKenzie appointed an official agent a few weeks prior to polling day for the 43rd federal general election. This official agent subsequently failed to provide the Chief Electoral Officer with the Candidate’s Electoral Campaign Return and required documents (Return), as required by the Canada Elections Act (Act).
When contacted by OCCE investigators, Eric MacKenzie indicated that he knew at the time of appointing the official agent that they would be incapable of performing the duties of the position. Section 477.42 of the Act required the candidate to appoint a replacement official agent without delay.
There are therefore reasonable grounds to believe that Eric Mackenzie failed to appoint a replacement official agent, as required by section 477.42.
