Key facts of violation
As the candidate for the Veteran's Coalition Party of Canada in the electoral district of Haldimand--Norfolk during the 43rd federal general election, Harold Stewart was required, by virtue of section 477.42 of the Act, to appoint a replacement official agent without delay, upon the resignation of his official agent.
On March 25, 2021, the OCCE investigator confirmed with Harold Stewart that his official agent had formally resigned previously and informed him of the requirement of the Act regarding the appointment of a replacement official agent. Elections Canada's records confirm that, as of November 23, 2021, a replacement official agent has not been appointed. There are therefore reasonable grounds to believe that Harold Stewart failed to appoint a replacement official agent, as required by section 477.42.
