As the financial agent for Ken Werbiski, a contestant in the electoral district of Portage–Lisgar during the 2019 Liberal Party of Canada nomination contest, Robert Painter was required, by virtue of subsection 476.75(7) of the Act, to file the Nomination Contestant's Campaign Return and required documents (Return) within four months after the selection date. The deadline to submit the Return was February 21, 2020.

Elections Canada confirmed that the Return was submitted to the Chief Electoral Officer on February 22, 2021, 367 days after the deadline.

There are therefore reasonable grounds to believe that Robert Painter failed to provide the Return within four months after the selection date, as required by subsection 476.75(7) of the Act.
