Key facts of violation
As the candidate for the People’s Party of Canada in the electoral district of Burnaby South during the 43rd federal general election (held on October 21, 2019), Al Rawdah was required, by virtue of section 477.42 of the Canada Elections Act (the Act), to appoint a replacement official agent without delay, upon the resignation of his official agent.
On March 17, 2021, Al Rawdah confirmed to the Office of the Commissioner of Canada Elections investigator that his official agent had resigned some time ago but no specific date was provided. Elections Canada’s records confirm that, as of January 31, 2023, a replacement official agent had not been appointed.
There are therefore reasonable grounds to believe that Al Rawdah failed to appoint a replacement official agent, as required by section 477.42 of the Act.
