As the candidate for the People’s Party of Canada in the electoral district of Hamilton East–Stoney Creek during the 43rd federal general election, Charles Crocker was required, by virtue of section 477.42 of the Canada Elections Act (the Act) to appoint a replacement official agent without delay upon the resignation of his official agent.
Charles Crocker’s former official agent provided the Office of the Commissioner of Canada Elections investigator with proof of his resignation effective January 16, 2020. Elections Canada’s records confirm that, as of February 8, 2023, a replacement official agent had not been appointed.
There are therefore reasonable grounds to believe that Charles Crocker failed to appoint a replacement official agent, as required by section 477.42 of the Act.
