Key facts of violation

As the official agent for the electoral campaign of Keith Komar, the Libertarian Party candidate in the electoral district of Toronto Centre during the by-election held on October 26, 2020, David Alexander Thomson was required, by virtue of subsection 477.59(1) of the Canada Elections Act (the Act), to provide the Candidate's Electoral Campaign Return and other required documents (Return) to the Chief Electoral Officer, outlining the financing and expenses for the candidate's electoral campaign.

As an extension of the filing deadline was granted by the Chief Electoral Officer, the deadline to submit the Return was April 26, 2021. Elections Canada's records show that as of March 15, 2023, the Return had still not been submitted.

There are therefore reasonable grounds to believe that David Alexander Thomson failed to provide the Return, as required by subsection 477.59(1) of the Act.
