As the official agent for the electoral campaign of Bob Jonkman, the Green Party of Canada candidate in the electoral district of Brantford-Brant during the 43rd general election held on October 21, 2019, David Legere was required, by virtue of subsection 477.59(7) of the Canada Elections Act (the Act), to provide the Candidate’s Electoral Campaign Return and other required documents (Return) to the Chief Electoral Officer, outlining the financing and expenses for the candidate’s electoral campaign, within four months after polling day.
The deadline to submit the Return was February 21, 2020. Elections Canada’s records confirm that the Return was provided to the Chief Electoral Officer on September 1, 2021, 559 days after the deadline.
There are therefore reasonable grounds to believe that David Legere failed to provide the Return within four months after polling day, as required by subsection 477.59(7) of the Act.
An aggravating factor was taken into account to increase the baseline amount of the AMP, as evidence from the Office of the Commissioner of Canada Elections demonstrates that David Legere has a history of non-compliance with the Act.
