Key facts of violation

As the candidate for the People’s Party of Canada in the electoral district of Kitchener South—Hespeler for the purposes of the 43rd federal general election held on October 21, 2019, Joseph Todd was required, by virtue of subsection 477.59(8) of the Canada Elections Act (the Act), to provide his official agent with the required declaration that the Candidate’s Electoral Campaign Return (Return) was complete and accurate within four months of polling day. This declaration was needed so that his official agent could submit the Return to the Chief Electoral Officer, as required by subsection 477.59(7) of the Act.

The deadline to provide the Return was February 21, 2020. Elections Canada’s records confirm that, as of March 28, 2023, the Return had not been submitted. The Office of the Commissioner of Canada Elections has determined that the Return could not be submitted because Joseph Todd had not yet provided his official agent with the required declaration.

There are therefore reasonable grounds to believe that Joseph Todd failed to provide his official agent with the signed declaration, as required by subsection 477.59(8) of the Act.
