As the official agent for the electoral campaign of Darryl Burrell, the People’s Party of Canada candidate in the electoral district of Windsor West during the 43rd federal general election held on October 21, 2019, Sean Penhale was required, by virtue of subsection 477.59(1) of the Canada Elections Act (the Act), to provide the Candidate's Electoral Campaign Return and other required documents (Return) to the Chief Electoral Officer, outlining the financing and expenses for the candidate's electoral campaign.
The deadline to submit the Return was February 21, 2020. As of February 22, 2023, Elections Canada's records show that the Return had still not been submitted to the Chief Electoral Officer.
There are therefore reasonable grounds to believe that Sean Penhale failed to provide the Return, as required by subsection 477.59(1) of the Act.
