As the official agent for the electoral campaign of Mathieu Castonguay, candidate for the Rhinoceros Party of Canada in the electoral district of Avignon–La Mitis–Matane–Matapédia during the 43rd general election held on October 21, 2019, Francis Castonguay was required, under subsection 477.59(7) of the Act, to file the Candidate's Electoral Campaign Return (Return) and required documents within four months of polling day. The deadline to submit the Return was February 21, 2020.

Elections Canada confirmed that the Return was submitted to the Chief Electoral Officer on April 20, 2021, 423 days after the deadline.

There are therefore reasonable grounds to believe that Francis Castonguay was in violation of the requirement to provide the Return within four months of polling day, as required by subsection 477.59(7).
