Key facts of violation
Kevin Lamoureux was the Liberal Party of Canada candidate for the electoral district of Winnipeg North during the 43rd federal general election. On October 21, 2019, polling day, the Office of the Commissioner of Canada Elections (OCCE) received a complaint alleging that election advertising for Kevin Lamoureux’s campaign appeared on Instagram and Facebook, in violation of section 323 of the Canada Elections Act.
A review of Facebook’s ad library established that seven advertisements were running on polling day.
When contacted by the OCCE, Kevin Lamoureux took responsibility for all seven ads. The ads reached approximately 35,000 persons on polling day and $290.09 was incurred by the campaign for the ads.
There are therefore reasonable grounds to believe that Kevin Lamoureux committed a violation of section 323 of the Act.
The AMP’s baseline amount was reduced based on a mitigating factor, as Kevin Lamoureux cooperated with the investigation and provided the OCCE with all the information he had regarding the election advertising in a timely manner.
