Key facts of violation

As the candidate for the New Democratic Party in the electoral district of Kitchener South-Hespeler during the 43rd federal general election (held on October 21, 2019), Wasai Rahimi received 13.30% of the votes cast. As a result, he was required, by virtue of subsection 477.1(2) of the Canada Elections Act (Act), to appoint an auditor without delay.

Subsection 477.1(2) requires that an auditor be appointed when a candidate has accepted contributions of $10,000 or more in total, incurred electoral campaign expenses of $10,000 or more in total, or received 10% or more of the votes cast in their electoral district.

Elections Canada's records confirm that, as of July 13, 2022, an auditor had not been appointed.

There are therefore reasonable grounds to believe that Wasai Rahimi failed to appoint an auditor, as required by subsection 477.1(2) of the Act.
