Key facts of violation

As the financial agent for Mike Kelloway, a Liberal Party of Canada contestant in the electoral district of Cape Breton--Canso during the 2019 nomination contest, Sonny MacDougall was required, by virtue of subsection 476.75(7) of the Act, to file the Nomination Contestant's Campaign Return (Return), within four months after the selection date. The deadline to submit the Return was February 21, 2020.

Elections Canada has confirmed that the Return was submitted to the Chief Electoral Officer on April 23, 2021, 427 days after its due date. There are therefore reasonable grounds to believe that Sonny MacDougall failed to provide the Return within four months after the selection date, as required by subsection 476.75(7).
