Michel Paulette, candidate in the 39th federal general election in the electoral district of Montcalm,

  1. Between on or about the 1st of January 2006 and on or about the 3rd of October 2007, in the City of Terrebonne (La Plaine), in the judicial district of Terrebonne and in the City of Mascouche, in the district of Joliette, or elsewhere in the Province of Quebec, unlawfully did steal a sum of money over $5,000.00, owed in part to the Receiver General of Canada and in part to the Conservative Party of Canada or to its Registered Association in the electoral district of Montcalm, contrary to subsection 322(1) of the Criminal Code, and did thereby commit an offence contrary to paragraph 334(a) of the Criminal Code.

  2. On or about the 12th of May 2006, in the City of Mascouche, in the judicial district of Joliette, in the Province of Quebec, or elsewhere in the Province of Quebec, being a candidate in the 39th federal general election held on January 23, 2006, took falsely an oath that is provided for by the Canada Elections Act, by signing a solemn declaration that the information in his Candidate's Electoral Campaign return submitted to the Chief Electoral Officer was correct and that all the election expenses associated to his campaign were duly recorded, while he knew or should have known that some information contained in the return was false and misleading and that some expenses or loans recorded as election expenses were not election expenses, contrary to subsection 549(3) of the Canada Elections Act and did thereby commit an offence contrary to subsection 500(5) of the Canada Elections Act.

  3. On or about the 20th of June 2006, in the City of Mascouche, in the judicial district of Joliette, in the Province of Quebec, or elsewhere in the Province of Quebec, aided, counselled or abetted James Gagné to submit to the Chief Electoral Officer a Candidate's Electoral Campaign return that he knew or should have known to contain information that was false or misleading, by aiding, counselling or encouraging James Gagné to report falsely, as election expenses in the said return, unjustified advances of funds made to him from election campaign funds and used for his personal needs, contrary to paragraph 463(1)(a) of the Canada Elections Act and did thereby commit an offence contrary to paragraphs 497(3)(v) and 500(5)(b) of the Canada Elections Act.
