Charges withdrawn – February 3, 2022

Accused: Daniel Berlin, from Toronto, Ontario
Facts: On October 22, 2020, two charges were sworn under the Canada Elections Act and the Criminal Code in the City of Toronto. The charges resulted from an investigation by the Commissioner of Canada Elections.
Offence:
  • Daniel Berlin was charged with obstructing the work of the Commissioner of Canada Elections by knowingly making a false or misleading statement during the course of the Commissioner's investigation.
  • Daniel Berlin and his brother David Berlin were also facing a joint charge of fraud under the Criminal Code.
Results:
  • As part of the legal proceedings, the file was referred to the Commissioner of Canada Elections by the Public Prosecution Service of Canada (PPSC) pursuant to subsection 517(7) of the Act.
  • On July 14, 2021, Daniel Berlin entered into a compliance agreement with the Commissioner.
  • On November 15, 2021, the charges against Daniel Berlin were withdrawn by the Crown.
