COMMISSIONER OF CANADA ELECTIONS

CANADA ELECTIONS ACT

Compliance agreement

This notice is published by the Commissioner of Canada Elections, pursuant to section 521 of the Canada Elections Act, S.C. 2000, c. 9.

On August 31, 2004, the Commissioner of Canada Elections entered into a compliance agreement with the contracting party in the city of Saint-Jérôme, Quebec, Canada, pursuant to section 517 of the Canada Elections Act.

In this agreement, the contracting party, candidate during the general election of June 28, 2004, in the electoral district of Rivière du-Nord, admits that pamphlets containing election advertising relating to her were distributed to addresses in the electoral district of Rivière-du-Nord without the indication of the authorization of the official agent required by section 320 of the Canada Elections Act. The contracting party acknowledges giving Robert Collerette the mandate to act as her official agent and Claude Rochon to manage communications during the electoral campaign. The pamphlets were created by Claude Rochon and authorized by her official agent. The error constituting a violation of section 320 of the Act was committed while the pamphlets were being printed.

Prior to the conclusion of the agreement, the Commissioner of Canada Elections took into account that the contracting party had correction notices published in the local newspapers: Le Mirabel and L'Écho du Nord.

In summary, the agreement required the contracting party to be aware of the requirements of the Act and to undertake to henceforth respect them.

Ottawa, September 13, 2004

RAYMOND A. LANDRY
Commissioner of Canada Elections
