Accused: Harvey Venier of Cranbrook, British Columbia
Facts: On August 21, 2012, five charges were sworn in the City of Cranbrook, in the Province of British Columbia.
Offence: Harvey Venier was convicted of contravening section 497(1)(r) of the Canada Elections Act for failing to open a separate bank account for the 40th (2008) general election, contrary to section 437(3) of the Act.

The other charges were dismissed.
Sentencing Date: September 16, 2013
Sentence: Absolute Discharge
Appeal: The Crown has appealed the dismissal of two charges, relating to section 463(1)(a) and 473(1) of the Canada Elections Act.

On May 20, 2014, the appeal was allowed and the acquittals were set aside.
